The use of our website and the content and services provided through it is at your own risk. Proofbox does not guarantee the accuracy, completeness, or timeliness of the information provided and is not liable for any damages resulting from the use of the content and functions of the platform. Our platform does not constitute legal or technical advice. Users must independently assess whether the offered products or services meet their requirements. This website does not, in any way, constitute legal advice and cannot replace it. We expressly recommend seeking professional advice. The texts are created and edited with care. However, no liability or responsibility is assumed for the availability, timeliness, accuracy, or completeness of the information. This also applies to databases accessible via the website or to websites linked from or to our website. Individual texts or articles, so-called whitepapers or freebies made available through the platform, are not intended to be legal advice and must not be understood or used as such. Proofbox is in no way authorized to provide legal advice of any kind. Consult an attorney before using any services from Proofbox!

The service products provided through our platform, particularly documents such as online disclosures, internet disclosures, defensive publications or other digital content, are intended for general use. For these products, technical and organisational measures are implemented that aim to enable them to be relied upon as evidence in court proceedings, patent disputes or other legal contexts. No assurance is given that this will succeed in an individual case. In general, however, Proofbox expressly offers only partial aspects of those services that may be necessary for preserving, enforcing, defending or exploiting intellectual property, namely exclusively the documentation and provision of prior art documents. It is explicitly noted that a defensive publication is solely evidence of publication and in no way proves ownership rights or the copyright of the author of a publication. A defensive publication therefore does not confer protection but serves to preserve freedom to operate by establishing prior art, and this only to the extent that freedom to operate already existed on the day of publication. A defensive publication that establishes prior art does not automatically confer full freedom to operate for the subject matter or process disclosed thereby. An infringement of third-party rights may still occur despite a defensive publication.

Under no circumstances does Proofbox claim that the services offered constitute comprehensive legal advice. It must not be assumed that professional legal advice, or even parts of it, can be replaced by the services of Proofbox. It is the user's responsibility to ensure that all products comply with legal requirements and are used properly. In any case, a lawyer or patent attorney must be consulted regarding any questions related to the services of this company.

Proofbox assumes no liability for damages resulting from the use or non-use of the provided content, unless such damages result from intentional or grossly negligent behavior on our part. In particular, we are not liable for indirect damages, lost profits, or other financial losses resulting from the use of the platform or the services. Our liability is limited to the extent permitted by law and to the amount of our rendered performance. Please also note the indemnification you accept for the use of our services. This can be found as part of our Terms and Conditions.

All content and products provided through our platform are protected by copyright. Any unauthorized reproduction, distribution, public presentation, or other use of the content is prohibited. The user receives only a non-exclusive, non-transferable right of use for the acquired products. Redistribution of the content to third parties is not permitted without our express written consent.

Users are required to use the platform and the content provided in compliance with applicable laws. This particularly includes refraining from uploading or downloading content that violates copyright law, data protection law, public decency, or other legal provisions. Proofbox reserves the right to block content or user accounts that violate these conditions.

The user of any Proofbox service is solely responsible for verifying the correct execution of a service. In particular, for the publication of an online disclosure, it is the user's responsibility to detect and report any discrepancy between the document submitted for publication and the version published by Proofbox. If such a discrepancy exists, liability and compensation are limited solely to the service provided by Proofbox and to the cost of that service. In particular, Proofbox accepts no liability for damages resulting from the user's failure to review or report such a discrepancy.

We employ technical measures so that subsequent changes to content provided become detectable. Through the use of timestamping, qualified sealing and encryption, the integrity of the products is technically safeguarded. Nevertheless, we accept no liability for technical errors beyond our sphere of influence, such as unauthorized access by third parties or transmission errors on the internet. In this context it should be noted in particular that, for example, timestamping (electronic signing) or other aspects of a defensive publication are provided as services of one or more third-party providers, or are integrated into Software-as-a-Service applications of Proofbox.

Our platform and its content are intended for use in various countries. However, regional legal restrictions or requirements may apply. It is the user's responsibility to ensure that the use of the platform and its products is lawful in their respective country. Proofbox assumes no liability for violations of local regulations.

This disclaimer is supplemented by our Terms and Conditions and Privacy Policy. These provide further important information on legal and usage-related aspects, particularly regarding the use of our platform and the content provided through it. Please read these documents carefully, as they contain essential information on liability, product usage, and legal recognition.

Proofbox reserves the right to amend this disclaimer at any time to reflect legal or technical developments. The current version is available on our website. Users are encouraged to review the disclaimer regularly.
